Warranty:
SAMS warrants and guarantees that all goods manufactured by or for SAMS has been formulated in accordance with SAMS' specifications and will be free from defects in material for a period of five (5) years or three (3) water intrusions from the Date of Installation of Stop Mold Treatments System^TM (SMTS). SMTS must be professionally applied by SAMS, or an authorized SAMS' distributor or contractor.

This warranty applies only to surfaces treated with SAMS' (SMTS). It is the obligation of the purchaser to maintain treated surfaces dry. The purchaser must inform SAMS or its authorized distributor in writing within five (5) days of discovery of any problem relating to SMTS. Failure to do so will relieve SAMS from any obligation under this warranty.

The purchaser understands that the effectiveness of SMTS will be compromised by alteration or water intrusion to the applied substrate. The purchaser is obligated to maintain "good housekeeping" practices, and ensure that:

1. In the case of water leakage or intrusion that all necessary repairs are made on a timely basis to stop any water leakage or intrusion.
2. In the case of any structural modification, SAMS or its authorized distributor will be contacted immediately, and if needed, the purchaser will purchase additional SMTS

Failure to do this will invalidate this warranty. Liability under this warranty will also be terminated if SAMS or its authorized distributor is prevented from fulfilling its obligations due to Force Majeure, act of God, fire, terrorism, quarantine, or any other circumstance beyond its control.

Subject to the disclaimers listed below, SAMS will replace defective product at its option, but will not be responsible for labor or material charges in replacing product or consequential damages. Any installation not conforming to SAMS' specifications, manuals, bulletins or instructions or any misuse or any modification not authorized by SAMS voids this warranty. The provisions of this warranty are in lieu of any other Provincial, State, and Federal statutory warranty, whether express or implied, written or oral, including any warranty of merchantability or fitness for a particular purpose. SAMS' maximum liability shall not exceed the actual purchase price paid for the product alone. In no event shall SAMS be liable for special, incidental, consequential, or indirect damages (including loss of profit) whether based on contract, tort or any other legal theory and irrespective of whether SAMS or its authorized distributors or contractors has advance notice of such damages.

Disclaimer:

1. Health, allergies, physical and/or symptomatic sensitivities.
2. Re-surfacing incompatibilities (paint, varnish, etc.)
3. Exposure to direct prolonged water intrusion (from fire hose, etc.)
4. Abuse or incorrect installation
5. Merchantability of fitness for any purpose or any other warranty, guarantee, or representation, expressed or implied, concerning SMTS.
